The "ElectrumHosting" brand is the trade name under which Edgar Torres Llavero provides its services. Hereinafter, "ElectrumHosting", "we" or "the provider".

02Purpose and acceptance

These General Terms of Contract and Use (the "Terms") govern the relationship between ElectrumHosting and any natural or legal person (the "Customer" or "User") who contracts or uses the services offered through electrumhosting.com and the client panel my.electrumhosting.com.

The purpose of the services is to provide hosting solutions, mainly virtual private servers (VPS) aimed at games (such as FiveM, Minecraft or Rust) and associated services (management panels, compute resources, network and support).

Contracting any service, registering an account or using the site implies full and unreserved acceptance of these Terms in their current version. If you do not agree, you must refrain from contracting or using the services.

03Registration, account and requirements

To contract, you must register an account providing truthful, accurate and up-to-date information. The Customer is responsible for the confidentiality of their credentials and for all activity carried out from their account.

The Customer declares that they are of legal age and have sufficient legal capacity to contract. If acting on behalf of a company, they declare having sufficient power to bind it.

You must notify us immediately of any unauthorized use of your account. We are not liable for damages arising from misuse of the credentials attributable to the Customer.

We may ask you at any time to verify or correct your account details (full name, ID document or tax number, address, city, state/province, postal code and country) and, where there are signs of fraud, to prove your identity or that you own the payment method used. We need this information to meet our legal invoicing obligations and to prevent fraud.

If the details provided are false, incomplete or unverifiable and you do not correct them within the period stated in our notice, we may suspend the service until the account is brought into order and, if the breach continues, terminate it and delete the hosted data in accordance with section 15. As this is a breach attributable to the Customer, suspension or termination for this reason does not give rise to any refund of the amounts paid, without prejudice to any mandatory rights granted by law.

You may not register accounts in the name of third parties without their authorisation, use payment methods belonging to others, or create new accounts to evade a suspension or cancellation.

04Contracting, prices and taxes

The applicable prices are those published on electrumhosting.com or in the panel at the time of contracting. Unless otherwise stated, prices are expressed in euros (EUR) and will include or add any legally applicable taxes (VAT or others), which will be detailed before confirming the order.

The contracting process ends with the confirmation of the order and its payment. You will receive the confirmation and the invoice by electronic means. We reserve the right not to accept an order for justified reasons (previous non-payment, suspected fraud, lack of stock or use contrary to these Terms).

We may modify the prices of the services; changes will not affect already-billed periods and will be communicated with reasonable notice before the next renewal.

05Payments, renewal and billing

Services are contracted in billing cycles (for example, monthly, quarterly or annual). Payment is made in advance through the enabled gateways (for example, card or PayPal) managed in the client panel.

Automatic renewal: unless cancelled beforehand, services renew automatically at the end of each cycle, generating the corresponding invoice and charging the amount to the configured payment method. You can disable renewal or cancel the service from the panel before the renewal date.

It is the Customer's responsibility to keep a valid payment method and sufficient funds. Issued invoices are available in the client panel.

06Non-payment, suspension and deletion

Non-payment of an invoice by its due date may lead to suspension of the service after due notice. During suspension, the service and its data may become inaccessible.

If the non-payment situation persists, we may permanently cancel the service and delete the hosted data after a reasonable period from the due date. We recommend downloading your backups before that date.

Reactivation of a service suspended for non-payment may be subject to settling the outstanding amounts.

07Right of withdrawal and refunds

If you contract as a consumer, you have a period of 14 calendar days to withdraw from the contract without justification, under Spanish Royal Legislative Decree 1/2007 (TRLGDCU).

However, as these are digital services with immediate activation, by requesting sign-up and start-up of the service during that period you expressly authorize us to begin providing it, and acknowledge that you will lose the right of withdrawal once the service has been fully performed, and must pay the amount proportional to what has already been provided (arts. 98.8 and 103, letters a) and m), of the TRLGDCU).

To exercise withdrawal, notify us by email at support@electrumhosting.com with an unequivocal statement. We will process any applicable refund via the same payment method used.

Renewals, refunds and any money-back guarantee are also governed by our Refund Policy.

08Acceptable use policy

The Customer undertakes to make lawful and diligent use of the services. It is expressly prohibited to use the services to, among others:

  • Carry out unlawful, fraudulent activities or ones contrary to morality and public order.
  • Carry out or take part in denial-of-service attacks (DoS/DDoS), offer or host "booter" or "stresser" services, or generate malicious, spoofed (IP spoofing) or amplification traffic.
  • Perform port or vulnerability scans, network sweeps or penetration tests against third-party systems without their express written authorisation.
  • Carry out brute-force attacks, credential stuffing, unauthorised access or any other intrusion technique against other people's systems, accounts or networks.
  • Distribute or host malware, ransomware, trojans or exploits, or control networks of compromised machines (botnets or command-and-control servers).
  • Host phishing, pages impersonating third parties, fraudulent shops or services, or trade in or use stolen data (credentials, payment cards or personal data).
  • Send unsolicited bulk email (spam) or host pages or services advertised through spam.
  • Operate open proxies or mail relays, Tor exit nodes, or VPN or proxy services without the measures needed to prevent third parties from using them for abusive activity.
  • Store or distribute content that infringes the rights of third parties (intellectual or industrial property, honour, privacy or self-image).
  • Host child pornography or any material exploiting minors, which will be reported to the authorities.
  • Host or spread content that incites hatred, violence or terrorism, or that amounts to harassment or threats.
  • Carry out cryptocurrency mining or other unauthorized intensive-consumption activities that degrade the performance of the infrastructure.
  • Consume resources abusively or endanger the stability, security or reputation of the network.
  • Resell the services without express authorization.
  • Engage in any other activity that results in well-founded abuse reports, in our IP addresses being added to blacklists, or in demands from providers, rights holders or authorities.

Breach of this policy may result in immediate suspension of the service, without prior notice where the seriousness or urgency of the case so requires and without any right to a refund, as well as any appropriate legal action.

Abuse reports: when we receive an abuse report relating to your service, we will forward it to you and you must respond and take the necessary measures within the period we specify, which may be 24 hours. If the activity is ongoing, affects third parties or puts our network at risk, we may suspend the service immediately without waiting for your reply. Serious or repeated breaches may lead to the permanent cancellation of the service and the account.

The Customer shall be liable for any damage that their misuse causes to ElectrumHosting or to third parties, including the reasonable costs of handling abuse reports and of removing our IP addresses from blacklists.

We will cooperate with the competent authorities where required by law and may provide them, in accordance with applicable regulations, with the information we hold about the service and its holder.

09Game licenses and customer content

The Customer is solely responsible for the software they install and run on their server, as well as for the content and end users of their game servers. In particular, they must respect the licenses and conditions of the owners of each game or platform, such as the Minecraft EULA (Mojang/Microsoft), the Cfx.re terms for FiveM or those of Facepunch Studios for Rust.

ElectrumHosting is not affiliated with or sponsored by those owners and grants no license over their games. Third-party trademarks are mentioned solely for descriptive purposes.

10Customer obligations and backups

The Customer undertakes to configure and maintain their service securely (strong passwords, updates, firewalls) and to comply with the legislation applicable to their activity.

Backups: unless a managed backup service is expressly contracted, the Customer is responsible for making and safeguarding their own backups. ElectrumHosting does not guarantee the preservation of hosted data and will not be liable for its loss, without prejudice to the security measures we apply to the platform.

11Availability, SLA and maintenance

We will use reasonable technical means to offer a highly available service, with an indicative target of 99.9% monthly uptime. However, the service may be affected by maintenance tasks, updates, force majeure or factors beyond our control (for example, network-provider failures or large-scale attacks).

Scheduled maintenance will be communicated in advance whenever possible. The specific service-level conditions and any compensation are detailed, where applicable, in our Service Level Agreement (SLA).

12Limitation of liability

ElectrumHosting will be liable for damages that are a direct consequence of breaching its obligations, within the limits allowed by law. To the maximum extent permitted by applicable regulations, we will not be liable for indirect damages, loss of profit, loss of data or business arising from the use or inability to use the service.

Except in cases of wilful misconduct or gross negligence, and without prejudice to the rights the law grants consumers, our total liability will be limited to the amount paid by the Customer for the affected service during the last months of provision.

We are not liable for content hosted by the Customer or for the use third parties make of their servers, in accordance with the liability regime for hosting service providers under the LSSI-CE.

13Intellectual property

The "ElectrumHosting" brand, the website, its design, logos, texts and other elements are owned by the provider or its licensors and are protected by intellectual and industrial property law. Their reproduction or use without prior written authorization is not permitted.

14Data protection

The processing of the Customer's personal data is governed by our Privacy Policy, drawn up under the GDPR and the LOPDGDD, which forms an integral part of these Terms.

15Suspension and termination

We may suspend or terminate the service, in whole or in part, in the event of a serious breach of these Terms, non-payment, fraudulent use or a requirement from a competent authority. Whenever possible, we will notify beforehand.

The Customer may cancel their services at any time from the panel, effective at the end of the current billing cycle, unless withdrawal or a refund applies under the law.

Where suspension or termination is due to a cause attributable to the Customer — in particular, false or uncorrected registration details (section 3), breach of the acceptable use policy or well-founded abuse reports (section 8), fraudulent use of the service or of the payment method, or an unjustified chargeback — the Customer shall not be entitled to a refund of the amounts paid, including the unused part of the current period, without prejudice to any mandatory rights granted by law.

16Referral programme

Participation: the referral programme allows Customers to earn credit for ElectrumHosting services by recommending us. Any Customer with at least one paid invoice (the "referrer") may take part, at no cost and without applying, and has a personal link and code in the client area. Taking part in the programme implies acceptance of this section.

Who counts as a referral: a new customer who signs up or places an order within 30 days of arriving through the referrer's link, or who uses the referrer's code on their first purchase. Only customers who have never paid an invoice are considered new. Each customer has a single referrer, permanently, and no one may refer themselves.

Commission: for each invoice paid by a referral, including renewals and for as long as they remain a customer, the referrer receives 10% of the amount actually collected, excluding taxes, or 15% if at the time of payment they have at least 5 referrals with an active service. Amounts paid with credit and free or complimentary services do not generate commission. We may agree different percentages with specific referrers.

Waiting period and review: each commission remains pending for 30 days and, if there is no refund, cancellation or chargeback during that period, it moves to the referrer's balance. Commissions showing signs of misuse (for example, when the referral and the referrer share a connection) will remain under review until we approve or cancel them.

Nature of the credit: the credit is a promotional discount on ElectrumHosting services, not money. It is non-refundable, cannot be exchanged for cash or transferred to another account and does not earn interest. It is applied as a discount line on the referrer's unpaid invoices (renewals, new services and billing cycle changes), automatically unless the referrer turns this off in the panel, and taxes are calculated on the amount left to pay. It does not apply to plan upgrades. It expires 12 months after being credited if unused, and the oldest credit is used first. If an invoice on which credit was applied is cancelled, the credit is returned to the balance.

Cancellation of commissions: if a payment that generated a commission is refunded, cancelled or charged back, the commission will be cancelled. If the referrer had already used it, the amount will be deducted from their future commissions.

Discount for the referral: the referrer's code entitles the new customer to a 5% discount on the first billing period of their first purchase, once per customer and not combinable with other coupons.

Misuse: it is not permitted to refer oneself, to use one's own accounts or third-party accounts without their consent to generate commissions, or to promote the link through spam, misleading advertising or by impersonating ElectrumHosting. In such cases we may cancel the commissions concerned, withdraw any credit improperly obtained and exclude the referrer from the programme, without prejudice to sections 8 and 15.

Changes and end of the programme: we may modify or end the programme at any time by publishing it at electrumhosting.com/referidos and in these Terms. Changes will not affect commissions already credited, and the available credit may be used until it expires. The credit is tied to the referrer's account and lapses if that account is permanently closed.

17Modification of the terms

We may modify these Terms to adapt them to legal, technical or business changes. The current version will always be the one published on this page, identified by its last-updated date. Substantial changes will be communicated by reasonable means and, if you continue using the service, will be deemed accepted.

18Applicable law, complaints and jurisdiction

These Terms are governed by Spanish law. For the resolution of any dispute, the parties submit to the Courts and Tribunals that apply under the relevant legislation. When the Customer acts as a consumer, the court of their place of residence will have jurisdiction.

If you are a consumer, you can also file your complaint with the consumer protection authority of your region or, if you live in another EU country, with the European Consumer Centre of your country (ECC-Net).
